The courthouse steps in Buffalo echo with an uncomfortable truth: when a teenager drove 200 miles to systematically murder Black shoppers in 2022, the law somehow found a way to shield the social media platforms that allegedly radicalized him. Last week, New York’s Fourth Department Appellate Division delivered that harsh reality in Patterson v. Meta Platforms, creating what Justice Stephen Lindley candidly called a “Heads I Win, Tails You Lose” proposition for social media companies.
The ruling—dismissing claims against Meta, Google, Discord, Reddit, and others—illuminates a legal landscape where algorithms that allegedly feed violence and hatred operate in a protected sanctuary, untouchable by traditional tort law. For New York attorneys, particularly those in personal injury practice, this decision represents more than just another adverse ruling. It’s a window into how decades-old internet law collides with modern algorithmic reality, creating outcomes that even sympathetic judges acknowledge feel manifestly unfair.
The Double Shield Defense
The Fourth Department’s analysis reveals how social media companies have constructed an almost impenetrable legal fortress using two constitutional and statutory shields. Either their content-recommendation algorithms don’t deprive them of Section 230 immunity as publishers of third-party content, or their algorithmic curation constitutes First Amendment-protected speech. Under no legal theory, the court concluded, are they left unprotected.
This isn’t theoretical legal maneuvering. The Buffalo shooter’s own writings, quoted in the dissent, capture the addiction these platforms allegedly create: “Why do I always have trouble putting my phone down at night? . . . It’s 2 in the morning . . . I should be sleeping . . . I’m a literal addict to my phone. I can’t stop consuming.” Yet even with such direct evidence of designed addiction leading to tragic violence, the law provides no remedy.
The majority opinion, while condemning the shooter’s “vile content” and actions, concluded that “there is in our view no reasonable interpretation of section 230 that allows plaintiffs’ tort causes of action to survive as against the social media defendants.” The platforms, Justice Lindley wrote, are entitled to immunity as publishers of third-party content.
When Addiction Becomes Algorithm
The case reveals how modern social media liability claims struggle within frameworks designed for a simpler internet. Plaintiffs alleged that social media platforms were “defectively designed to include content recommendation algorithms that fed a steady stream of racist and violent content to the shooter, who over time became motivated to kill Black people.” The platforms, they argued, deliberately exploited neurological vulnerabilities to maximize engagement and profits.
But the Fourth Department saw this differently. Drawing from Second Circuit precedent in Force v. Facebook, the court concluded that algorithmic content curation represents traditional editorial functions, comparing Facebook’s algorithm to newspaper editors deciding which stories merit front-page placement. While the Fourth Department issued its stark conclusion, parallel litigation nationwide shows the law’s unsettled nature. The federal multidistrict litigation MDL 3047, pending before Judge Yvonne Gonzalez Rogers in the Northern District of California, encompasses nearly 600 cases against social media companies, with the first bellwether trial scheduled for October 2025. In November 2023, Judge Rogers rejected the companies’ Section 230 and First Amendment defenses for negligence claims, finding that certain platform features like image filters could be treated as products rather than pure speech.
The contrast is striking. While New York’s appellate court found algorithmic content curation indistinguishable from traditional publishing, federal courts in California have begun parsing different platform features more granularly. Judge Rogers determined that social media platforms “facilitate interactive experiences” rather than functioning as static products, but concluded that features promoting “unrealistic beauty standards” through filters weren’t entitled to First Amendment protection as “neutral, nonexpressive tools”.
The Reform Landscape: Searching for Solutions
The mounting legal pressure has sparked legislative attention, though meaningful reform remains elusive. The Department of Justice has proposed concrete Section 230 reforms, including a “Bad Samaritan Carve-Out” that would deny immunity to platforms that “purposefully facilitate or solicit third-party content or activity that would violate federal criminal law,” and specific exemptions for child exploitation, terrorism, and cyber-stalking claims.
The SAFE TECH Act, reintroduced by Senators Warner and Hirono, would create liability for platforms that fail to address “cyber-stalking, online harassment, and discrimination,” forcing online service providers to “address misuse on their platforms or face civil liability”. But critics worry such broad language could fundamentally reshape internet commerce, potentially affecting everything from Substack newsletters to e-commerce platforms.
More targeted approaches are emerging. Harvard’s Ash Center has proposed a “repeal and renew” framework that would “remove the liability shield for social media companies’ algorithmic amplification while protecting citizens’ direct speech,” distinguishing between constitutionally protected “fearless speech” and harmful algorithmic amplification that causes “demonstrable harm”.
The Practitioner’s Dilemma
For New York attorneys considering social media liability cases, the Fourth Department’s ruling creates immediate strategic challenges. The court’s finding that allowing the lower court’s ruling to stand “would gut the immunity provisions of Section 230 and result in the end of the Internet as we know it” suggests deep judicial reluctance to narrow these protections, even in cases involving deadly violence.
Yet the split with federal courts offers hope. The MDL proceedings continue to allow certain claims to proceed, particularly those focused on product design features rather than content moderation. As of July 2025, nearly 620 cases remain pending in the federal MDL, with trials scheduled throughout 2025 and 2026. The difference in outcomes between state and federal courts may ultimately require Supreme Court resolution.
The dissent’s product liability theory also provides a roadmap for future cases. By focusing on design defects like “push notifications and messages throughout the night” and features that “autoplay video without requiring the user to affirmatively click,” plaintiffs might distinguish their claims from pure content moderation disputes. The key is demonstrating that platforms could address these harms through design changes that don’t require reviewing or editing third-party content.
Justice in the Age of Algorithms
The Fourth Department’s “Heads I Win, Tails You Lose” formulation captures more than legal doctrine—it reflects a justice system struggling to address harms that traditional law never contemplated. When Justice Lindley wrote that Section 230 is “the scaffolding upon which the Internet is built,” he acknowledged both its foundational importance and the difficulty of reform.
The Buffalo families’ quest for accountability illuminates this broader challenge. Their loved ones were killed by someone who, by his own admission, became addicted to platforms designed to maximize engagement through increasingly extreme content. Yet the law, as currently interpreted, provides no remedy for this algorithmic manipulation, no matter how deadly its consequences.
Perhaps Justice Lindley was right that reforming Section 230 would fundamentally change “the Internet as we know it.” The question facing lawmakers, judges, and practitioners is whether that change is overdue. The platforms’ legal immunity may be intellectually defensible, but when teenagers drive hundreds of miles to commit mass murder after algorithmic radicalization, something more than legal doctrine demands attention.
Until Congress acts or the Supreme Court intervenes, attorneys and their clients will navigate this impossible legal landscape—where the most sophisticated tools for manufacturing consent and addiction operate beyond traditional accountability. The law’s certainty provides little comfort when justice itself feels increasingly algorithmic.
